Like most states, the custody provisions for children in California is the best interest of the child with an emphasis on ensuring the health, safety and welfare" of the child and "frequent and continuing contact with both parents absent from child abuse, domestic violence, or if the contact is not in the best interest of the child, as in the California Family Code Section 3011 (See California Family Code Section 3011, 3020, 3040, 3080). Further, according to California Family Code section 3040, child care should be included in the ranking and to the best interest of the child.
A common challenge for the court to decide who gets custody of the child. Child custody may be requested by parents, grandparents, step parents, or any person who believes they may require an appropriate support and counseling for the child. How does the California family court or a California judge competing with people around the custody of the child? Under California Family Code section 3040, child care should be included in the ranking and to the best interest of the child. The court is first to grant custody to both parents jointly or to either parent to be granted before they enter the custody of other persons. California currently does not, however, a setting or a presumption for or against joint custody arrangements. Instead, it allows the family court or California California judge, the education agreement, a decision on a case-by-case basis according to what it believes reflects the overall welfare of the child.
