To file for dissolution of marriage, separation or nullity of marriage or your spouse must be residents of the region you are in. As a resident filing generally means that you live in this region and to live in this region for the foreseeable future. There is no minimum time for a legal separation or nullity of marriage.

On the other hand, if you are looking for a dissolution of marriage (divorce), California law requires that either you or your spouse is a resident in the province, where the application for dissolution of marriage filed for a period of at least three months and the State of California for at least six months before the petition can be submitted.

Example: If you and your spouse have divorced, and residents of Sacramento County in the last seven months, would you consider your petition in Sacramento County Superior Court, however, if you are from the family home to Yolo County, and now even a resident Yolo County, you can (1) Wait at least three months and then file your petition in Yolo County, or you can use your petition in Sacramento County (assuming that your spouse remain in Sacramento County).

If you have recently entered a new region and you are anxious to get things moving and you want the divorce to take, where you live, you can present a petition for legal separation immediately (the day on which you look for Yolo County ) and then, if you have been a resident of the new province for three months, you can amend your petition to the dissolution of the marriage.

Some lawyers make a note on the petition for legal separation, that the petition is the petition to the residence for the dissolution of the marriage.
