You can with an eviction if your home is sold because of a foreclosure sale. Regardless of whether a sale by auction or by a trustee sale, the eviction is the legal procedure in which an owner physically removes a tenant or trespasser.

Evictions of tenants are protected by strict contract law and the tenant often has more rights than the landlord. In many states, tenants can sue their landlord for breach of contract, possibly harassment and receive many times their monthly rent if they win the litigation. In some cities, it is extremely difficult, displacement of tenants, for any reason. This is not the case with foreclosure evictions, because the former homeowners are not tenants. Well-meaning people often tell foreclosure victims about experiences they know where the tenant / landlord law was. Again, this is not the case, where Foreclosure involved.

Foreclosure evictions are a little different in most cities, it is important that you contact the court issuing the eviction order to determine what to expect. The person who serves the eviction notice, or contributions to the front door is usually not the same person, the enforcement of the eviction. The clearance is determined by a representative of the court, often a county sheriff or policeman. Occasionally, the person, the notice will tell you that you "really", "have an additional 24 hours, but do not expect that this additional time. Plan to complete before the actual deadline.

The actual eviction may be different, but often an officer of the court (sheriff or policeman) accompanies the new owner or his representative, the ownership and all the warnings in the premises that the eviction is within a few minutes. In this case, the owner's representative is responsible for the removal of everything that they do not want that out of the premises.
